Service Description

1. Teletyped provides an AI chatbot user interface that allows users to interact with multiple large language models, including ChatGPT, Anthropic's Claude, and Mistral's models.
2. Teletyped also offers software development, design services, and AI consulting services to businesses and individuals.
3. Key features and functionalities of our AI platform include saving chats, deleting chats, setting chats to auto-delete after a certain period, regenerating messages from an AI, searching chats, and recharging credits.
4. The use of the AI Services is subject to the limitations and restrictions set forth by the respective model providers, including OpenAI, Anthropic, and Mistral. Users must not use model outputs for any harmful means, as per the providers' terms of service.
5. Professional services include but are not limited to: custom software development, UX/UI design, AI implementation, AI strategy consulting, and systems integration.

User Registration and Account Management

1. To access the AI platform Services, users must provide their name, email, and password and subscribe for $25/month.
2. Users can create an account by subscribing on the main page and may delete their account or pause their subscription from the settings.
3. Users are responsible for maintaining the security of their accounts and should use a secure, unique password.
4. For professional services (software development, design, and AI consulting), separate service agreements will be established on a project-by-project basis.

Intellectual Property Rights

1. The ownership and rights over the AI chatbot technology and content are subject to the terms of service of OpenAI, Anthropic, Mistral, and other model providers. Their respective terms of service apply.
2. For custom software development, design, and consulting services:
   • Unless explicitly stated otherwise in a separate agreement, Teletyped retains ownership of all pre-existing intellectual property used in the development of custom solutions.
   • Upon full payment for services, clients receive a non-exclusive license to use the deliverables for their intended purpose.
   • Custom software code and designs created specifically for a client and paid for in full will be owned by the client, unless otherwise specified in a separate agreement.

Payment and Billing

1. The AI platform Services are offered as an AI chat interface with a subscription fee of $25/month, which includes $15 for the subscription and $10 for model credits. Users may recharge credits via the settings.
2. For professional services (software development, design, and AI consulting):
   • Fees will be specified in individual service agreements or statements of work.
   • Payment terms, including deposits, milestone payments, and final payments, will be outlined in these agreements.
   • Hourly rates or project-based pricing will be determined based on the scope and complexity of each project.
3. Billing cycles for the AI platform are monthly, with annual plans coming soon.
4. We do not offer refunds for used model credits or for completed professional services.

Data Privacy and Security

1. We collect and process user data, including name, email, password, and chats with the AI. Data is stored on Digital Ocean servers in the US.
2. For professional services clients, we may collect additional information necessary to provide the services, including but not limited to business requirements, system specifications, and user feedback.
3. Chat data is stored on our servers but is permanently deleted when a user deletes it. However, the data may linger in our model providers' data centers as per their privacy policies.
4. Client data obtained during the provision of professional services will be handled according to confidentiality terms specified in the relevant service agreements.
5. We strive to comply with relevant data protection laws, such as GDPR and CCPA.
6. We do not use cookies but may collect usage data to address bugs.

User Conduct and Responsibilities

1. Users must adhere to the acceptable use terms of service of our AI providers (e.g., OpenAI, Anthropic, and Mistral) when interacting with the AI chatbots.
2. Clients of our professional services must provide timely and accurate information necessary for the successful delivery of services.
3. Prohibited activities and content are governed by the respective terms of service of the above-mentioned companies and by specific provisions in individual service agreements.

Limitation of Liability

1. Teletyped disclaims and limits its liability to the extent permitted by law.
2. For professional services, specific limitations of liability will be outlined in individual service agreements.
3. If you are a business or organization, to the extent permitted by law, you will indemnify and hold harmless Teletyped, its affiliates, and its personnel from and against any costs, losses, liabilities, and expenses (including attorneys' fees) from third-party claims arising out of or relating to your use of the Services and Content or any violation of these Terms.

Termination and Suspension

1. Teletyped may terminate or suspend user accounts if the user violates any of the terms of service set forth by our AI providers (e.g., OpenAI, Anthropic, and Mistral) that would typically result in account termination or suspension.
2. For professional services, termination conditions will be specified in individual service agreements, including notice periods and payment for work completed.

Dispute Resolution and Governing Law

1. These Terms shall be governed by and construed in accordance with the laws of the United States.
2. For professional services, specific dispute resolution procedures may be outlined in individual service agreements.

Updates and Modifications

1. Teletyped reserves the right to update and modify these Terms in the future.
2. Users will be notified of any changes to the Terms via email.

Third-Party Services and Integrations

1. The Services integrate with third-party AI providers (e.g., OpenAI, Anthropic, and Mistral), and use Digital Ocean for servers.
2. Professional services may involve the integration of third-party software, APIs, or services as required by project specifications.
3. Users and clients are responsible for complying with the terms and privacy policies of these third-party services.

Age Restrictions and Parental Consent

1. Users must be at least 13 years old or the minimum age required in their country to consent to use the Services.
2. Users under 18 must have the permission of a parent or legal guardian to use the Services.

Professional Services Warranties and Guarantees
